What cannot be sold on Merka, how listings are checked, and what we do with an account that breaks these rules.
What cannot be sold
Weapons and ammunition, narcotics, medicines, official documents, live animals, counterfeits, and any item whose sale between private individuals is prohibited in Switzerland.
How listings are checked
Listings are checked automatically, on the text and on the photo. We withdraw without notice a listing that breaches this rule.
Report to us anything that appears unlawful. Every listing carries a report link, and every report is read. You do not have to be certain: it is up to us to verify.
What we do
We withdraw, we suspend, and we report. Faced with manifestly unlawful content, we withdraw the listing, suspend or close the account without notice, and pass the file to the competent authorities. This applies whatever the state of ongoing sales and whatever the amounts involved.
One practice concerns us in particular: the cover listing, an ordinary item displayed at a price bearing no relation to its value, sometimes accompanied by an age and a size. We do not seek to know what it hides. We withdraw it from sale, we close the account, we refer the matter to the competent authorities ourselves without waiting to be asked, and we hand them everything we hold: the listing, its photos, the messages, the successive prices, the sign-in identifiers and the payment data. Nothing is deleted after a report of this kind; the material is kept offline and held at the disposal of the courts.
The money of a closed account
Sums held on behalf of a user whose account is closed are frozen, not kept by us: they are returned, refunded to the buyer, or held at the disposal of the authority that decides on them. A buyer in good faith whose order is cancelled for this reason is refunded in full.
